Terms of Service

1. Eligibility

You must be at least 18 years of age to use the Service. By using Bimbofy.Me, you represent and warrant that you meet this age requirement. Users found to be under 18 will have their accounts immediately terminated and all data deleted. The Service is intended for entertainment and satirical purposes only.

2. Account Registration

You must provide accurate information when creating an account, including a valid email address and your true date of birth. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at legal@bimbofyme.app if you suspect unauthorized access to your account.

3. Acceptable Use

You agree that you will not use the Service to:

• Upload images of individuals without their express, informed, written consent
• Upload images of minors (under 18) under any circumstances
• Generate, distribute, or store non-consensual intimate imagery (NCII) of any kind
• Impersonate any person, organization, or entity
• Upload content that is illegal, defamatory, harassing, or threatening
• Attempt to reverse-engineer, scrape, or extract data from the Service or its AI models
• Use automated tools, bots, or scripts to access the Service without prior written consent
• Circumvent, disable, or otherwise interfere with security features of the Service
• Use the Service for any commercial purpose without our prior written consent
• Violate any applicable local, national, or international law or regulation

4. Image Uploads & Consent

By uploading any image to the Service, you represent and warrant that:

• You are the individual depicted in the image, or
• You hold express, informed, written consent from every individual depicted in the image to use their likeness for this specific satirical, AI-transformation purpose
• The image does not depict any individual under the age of 18
• You have the legal right to upload and process the image

We reserve the right to remove any content that violates these requirements and to terminate accounts associated with such violations, with or without notice, and to report violations to appropriate law enforcement authorities.

5. AI-Generated Content

All images generated by the Service are produced by xAI's Grok Imagine API and are fictional, satirical caricatures. Generated images are intended for personal, entertainment use only. You retain ownership of images you upload. With respect to generated outputs, you are granted a limited, non-exclusive, personal, non-transferable licence to use, share, and display outputs for non-commercial purposes.

We reserve the right (but have no obligation) to display your generated images on our public Leaderboard. You may opt out of Leaderboard display at any time via your account settings.

6. Credits & Payments

The Service operates on a credit-based system. Credits are consumed when you generate images. Credits are non-refundable except as required by applicable consumer protection law. Credits do not expire while your account remains active. We reserve the right to modify credit pricing and allocation at any time, with notice to existing subscribers.

All payments are processed by Stripe, Inc. By making a purchase, you also agree to Stripe's Terms of Service. Subscription fees are billed on the terms stated at the time of purchase.

7. Intellectual Property

The Bimbofy.Me brand, logo, name, website design, and all software are the intellectual property of Bimbofy-Me LLC and are protected by applicable intellectual property laws. You may not copy, reproduce, modify, or create derivative works of any part of the Service without our express written permission.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully to understand our data practices.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED CONTENT WILL MEET YOUR EXPECTATIONS.

AI-generated images are fictional caricatures. Any resemblance to real persons beyond the subject of the uploaded photograph is coincidental. We are not responsible for how third parties may interpret or react to generated content.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BIMBOFY-ME LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Bimbofy-Me LLC and its officers, directors, employees, and agents from any claim, liability, damage, loss, or expense (including reasonable legal fees) arising from your use of the Service, your uploaded content, or your violation of these Terms or any third party's rights.

12. Termination

We may suspend or terminate your access to the Service at any time, for any reason, including violation of these Terms, with or without prior notice. You may delete your account at any time from your Profile page or by emailing legal@bimbofyme.app. Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved through binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property or confidentiality matters.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you by email and post the revised Terms on this page with an updated effective date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
